Payment & Cancellation Policies
1. Photographer is the exclusive, official photographer retained to perform photographic services requested on this contract. Photographer and assistants of the Photographer take precedence over any videographer or vendor hired during the session.
2. RESPONSIBILITIES: Photographer is not responsible for compromised coverage due to causes beyond the control of Photographer including, but not limited, to obtrusive guests, lateness of the Client or guests, weather conditions, schedule complications, incorrect addresses provided to the Photographer, rendering of decorations, or restrictions of the locations. Photographer is not responsible for backgrounds or lighting conditions which may negatively impact or restrict the photo coverage. Photographer is not held liable for missed coverage of any part of the event(s). Photographer will not be held accountable for failure to deliver images of any individuals or any objects at the event(s).
3. Photographer reserves the right to use negatives, RAW images, edited images and/or reproductions for advertising, display, publication or other purposes, not restricted to use on the web, Facebook, business cards, or posters. Client consents to the Photographer’s use of the Client’s images for these purposes.
4. Original photographs are not included within the photography services, only edits. Photographer retains the right to edit the photographs and omit any image. It is understood that the photographer will not deliver every exposure taken. Client agrees to abide by Photographer’s editing decisions. If Client would like the Photographer to re-edit images, it is up to the Photographer’s discretion. A re-editing fee will be incurred up to $50 an hour. If Client would like to “re-shoot” a session, the negotiated price and scheduling will be up to the Photographer’s discretion.
5. Client will receive photos via digital library where photos will be available for download with print release for personal use. Digital download library includes images for printing and may be used on the web, Facebook, or email.
6. Client agrees that when publishing photos on websites, (i.e. personal website, Facebook, etc.), that client will NOT edit the photos in any way, (i.e. editing the watermark, cropping, filters, etc.)
7. Client is responsible for making a backup of all photos from the digital download library. Photographer will not be required to keep archival copies of photos. Backup copies are for client use only and may not be distributed to others.
8. Client will not hold Photographer, or the owner of the property used for photography session, liable for any injury that may occur during the session.
9. SAFETY: Photographer reserves the right to terminate coverage and leave the session if Photographer experiences inappropriate, threatening, hostile or offensive behavior from person(s) at the session; or if the safety of Photographer is in question.
10. The charges in this contract are based on Photographer’s Standard Price List. The Standard Price List is adjusted periodically. The charges of the session are due before or on the day of the shoot. After seven (7) days without full payment, Client will be charged a $50.00 late fee every additional week of non-payment. Client may be required to provide a non-refundable deposit to hold their session. The amount of the deposit is non-negotiable and based upon Photographer’s discretion.
11. Completion of processing and edits of a photography session may take up to one to three weeks for delivery.
12. In the event Photographer has equipment failure, an emergency arises on the way to a session, or other unforeseen circumstances arise, Photographer agrees to reimburse Client for the compensation received up to that point. Photographer is not liable for any other compensation to Client besides what has been received.
13. NOTICE OF COPYRIGHT: It is ILLEGAL to copy or reproduce these photographs without Photographer’s permission. Photographer retains copyright to the photographs. Printing and/or distribution rights granted as noted.
14. FOR ALL SESSIONS: Photographer understands weather, illness, or other reasons may cause Client to reschedule a session. Client will not be charged a penalty for rescheduling a session provided at least a two weeks notice is given. Client may reschedule the session, at the convenience of Photographer, without being charged a fee. Client understands that booked dates are essential to the Photographer’s business and may be charged a $50 cancellation fee when cancelling a session, not showing up for a session, or choosing to reschedule a session. In the event of a cancelled session, Photographer is not required to provide any services or deposit refunds to the Client. Photographer may reschedule without penalty. In the event of bad weather, the Client or Photographer may choose to reschedule without penalty.
15. TRAVEL: For sessions within the area of Fort Bend county area, travel is included in the session fee. If the session is not within this area, additional fees will be added. Travel fees are based on mileage to and from the location or housing (if necessary) and may change. All travel fees MUST be prepaid.
16. Client shall indemnify Photographer for any injury caused to the Photographer during a session that is the fault of the Client.
